These are the course booking terms referred to in our Website Terms and Conditions of Use. They govern bookings for Legatia Law training courses and form part of the contract between you and us, so please read them before you book.
Who we are
Legatia Law is the trading name under which Miriam Bailey-Parkyns provides mediation and professional training. In these terms, “we”, “us” and “our” mean Legatia Law, and “you” means the person named in the booking as the delegate.
Our address is 1 Knightsbridge Green, Knightsbridge, London SW1X 7NE. You may contact us by email at prof.develp@legatialaw.com.
Your booking
These terms apply to every booking for a Legatia Law training course, including the Five-Day Civil and Commercial Mediator Training Programme. The fee for each course is stated on the booking page.
The fee is payable in full at the time of booking. Your booking is accepted, and the contract between us is made, when we receive your payment and confirm your place to you by email. Places are limited and are allocated in the order in which payment is received.
Your place
A place is personal to the delegate named in the booking and cannot be transferred to another person. Full attendance on every day of the course, and completion of the pre-course reading, are required.
Where a course leads to accreditation, accreditation depends on your performance in the assessed role play, measured against the published criteria. Payment of the fee secures your place on the course and your assessment. It does not secure accreditation. The Assessment Appeal Procedure is sent to you with the confirmation of your booking.
Your right to cancel if you book as a consumer
If you book as an individual acting for purposes wholly or mainly outside your trade, business, craft or profession, you are a consumer, and you have a legal right to cancel your booking within 14 days after the day on which the contract is made, without giving any reason.
To cancel, you must tell us clearly, by email to prof.develp@legatialaw.com, before the 14 days have passed. You may use the model cancellation form at the end of these terms, but you are not obliged to do so. If you cancel within that period, we will refund the fee in full, using the same means of payment you used, without undue delay and in any event within 14 days after the day on which you tell us.
If you book a course that begins within 14 days after the day on which you book, you expressly request that the course be provided to you within the cancellation period, and you acknowledge that you will lose the right to cancel once the course has been provided in full. If you cancel after the course has begun, you must pay for the part of the course provided up to the time you tell us, in proportion to the whole course.
Cancellation after the 14 days, or where you book in the course of business
Where the 14-day right does not apply, or has come to an end, you may still cancel your booking by email to us. The refund then depends on the date on which we receive your email, counted back from the first day of the course.
More than 60 days before the course, we will refund the fee paid, less an administration charge of £250 plus VAT. Between 60 and 30 days before the course, we will refund one half of the fee paid. Fewer than 30 days before the course, or if you do not attend, no refund is due, because a place released so close to the course cannot ordinarily be filled.
Transfer to a later course
You may transfer your booking once, to a later course, if you ask us to do so by email at least 30 days before the first day of the course you have booked. A transfer is subject to the availability of a place on the later course. These terms apply to the later course in the same way, and a booking may be transferred only once.
If we cancel or change a course
We may need to cancel a course, or move it to another date, for reasons beyond our reasonable control or where too few places have been taken. If we do, we will tell you as soon as we reasonably can, and you may choose either a full refund of the fee paid or a transfer to the next course.
We may make reasonable changes to the timetable or to the venue in London. We will tell you of any such change before the course begins. We are not responsible for travel, accommodation or other costs you incur in connection with a course, and we recommend that any such arrangements you make can be changed or refunded.
Conduct
We expect every delegate to take part in the course, including the role play, with courtesy towards the trainer, the assessors and the other delegates. We may ask a delegate whose conduct seriously disrupts the course to leave it. In that event no refund is due.
Course materials
The course materials are provided for your own professional use. Copyright in them belongs to Legatia Law or to the relevant author, and they may not be copied, shared or published without our written permission.
Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be limited or excluded. Subject to that, our total liability to you in relation to a booking is limited to the fee you have paid for it. We are not liable for any loss of profit, loss of business or indirect loss.
If you are a consumer, these terms do not affect your statutory rights, including your right to have the course provided with reasonable care and skill.
Your personal data
We use the personal data you give us when you book only to administer your booking, the course and your assessment. Our Privacy Policy explains how we handle it.
Complaints
If you are dissatisfied with any aspect of a course, please tell us. Our Complaints Procedure explains how to complain and what we will do.
Governing law
These terms are governed by the law of England and Wales, and disputes arising in connection with them are subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the United Kingdom in which you live.
